General Policy
CPAs are bound by
professional standards of confidentiality that are more
stringent than required by law. Burney & Associates
recognizes the need for protection of information gathered from
clients. Your privacy is important to us and we are committed to
protecting your privacy. We do not disclose any non-public
information about our clients or former clients with anyone except
as may be authorized by the client, required under legal
proceedings, or permitted by law.
From time to time, we acquire
non-public and public information about you from various sources,
including:
- Information we receive from
interviews with you regarding your business, personal, and/or
tax situations
- Information we receive from you
on applications, organizers, or by other means
- Information from documents
provided to us such as Forms W-2, 1099R, 1099-INT, 1099-DIV,
stock transactions, K-1s and various other formal documents
The information we may acquire
includes but is not limited to your name, address, contact
details, Social Security or Tax Identification numbers (including
EINs), dependents, income, assets, liabilities, and other
business, personal, and tax financial and non-financial
demographic data.
Permitted disclosures include, for
instance, providing information to our employees and, in limited
situations, to unrelated third parties who need to know that
information to assist us in serving the client. In all such
situations, we stress the confidential nature of information
shared.
We retain records relating to
professional services that we provide so that we are better able
to assist the client and to comply with professional guidelines or
requirements.
Electronic Data
Burney & Associates
will maintain sensitive financial data in encrypted format while
in the control of systems presently actively administered by
Burney & Associates (including general ledger software, tax
software, archived email, and electronic facsimiles).
Regarding electronic mail (commonly
referred to email, chat, or messaging systems, among other
monikers and hereinafter collectively referred to as "email") and
facsimile systems, Burney & Associates cannot guarantee the
confidentiality of any data communicated to us by a client using
an email system. Upon receipt, Burney & Associates' Privacy Policy
applies, however, due to the naturally insecure environment of
email systems, Burney & Associates cannot guarantee nor be held
accountable for insecurities or violations of privacy external to
systems controlled by Burney & Associates. Clients agree to
indemnify Burney & Associates from any responsibility associated
with privacy violations occurring outside of Burney & Associates'
systems, including, but not limited to, mail server insecurities,
website violations (including "hacking"), mis-directed email and
fax documents, or any other form of electronic weakness or
violation occurring outside of systems actively controlled by
Burney & Associates.
Regarding form submissions on the
Burney & Associates, CPAs website, we will ensure that all data of
this nature is stored in a secured directory under our domain
name. Practical security measures, namely a user identification
and password, will be required to access this data. The client
understands that this data is within the servers of the hosting
service and is not controlled by Burney & Associates other than to
install a user identification and password. Burney & Associates
cannot guarantee nor be held accountable for insecurities or
violations of privacy external to systems controlled by Burney &
Associates. Clients agree to indemnify Burney & Associates from
any responsibility associated with privacy violations occurring
outside of Burney & Associates' systems, including, but not
limited to website violations (including "hacking").
Physical
Documentation
Burney & Associates
maintains physical documentation within our offices, which are a
secured facility. Only authorized individuals are allowed to
access our files or enter the premises during off hours.
